By accessing, browsing, or utilizing GenMago (available at https://genmago.com), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any applicable operating guidelines or platform rules.

If you do not agree to these Terms, you must discontinue your use of our website, AI generation interfaces, and APIs immediately.

Creator Ownership: As between you and GenMago, you own all rights, title, and interest in the original character designs, images, and text prompts you generate using the platform.

Commercial Rights: GenMago grants you an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, distribute, sell, and monetize the images and character assets you create. You may incorporate them into commercial video games, books, merchandise, webtoons, brand assets, and marketing campaigns.

No Watermarks: All generated outputs are delivered without watermarks or intrusive proprietary branding, enabling seamless integration into your professional creative pipeline.

GenMago is committed to maintaining a safe, ethical, and legally compliant generative AI platform. You strictly agree not to use GenMago, its prompts, models, pipelines, or APIs to create, synthesize, upload, or share:

• Child Sexual Abuse Material (CSAM) or any visual or textual sexualization, exploitation, or suggestive depiction of minors and children (Zero Tolerance: any violation triggers immediate account termination, content eradication, and mandatory reporting to law enforcement and child protection authorities).

• Sexually explicit, adult, NSFW, pornographic, or erotic visuals, nudity, transparent/sheer revealing clothing, undergarments, bathing suits in sexualized contexts, or lewd physical poses.

• Non-consensual sexual synthetic imagery, intimate deepfakes, or unauthorized synthetic depictions of real persons.

• Extreme violence, gore, mutilation, blood, physical harm, weapons, terror, or encouragement of suicide and self-harm.

• Hate speech, discriminatory harassment, abusive epithets, or threats targeting individuals or groups based on race, religion, gender, sexual orientation, disability, or nationality.

• Content that infringes upon the intellectual property, copyright, trademark, or privacy rights of any third party.

• Malicious scripts, scrapers, Denial of Service (DoS) attacks, automated load, or attempts to bypass security, moderation, and safety filters.

Unilateral Enforcement Rights: GenMago reserves the absolute, unilateral, and unconditional right to remove, permanently delete, or immediately hide (set to private/unlisted) any generated image, prompt, or user account without prior notice, warning, explanation, or refund, whenever GenMago determines or suspects in its sole discretion that the content violates this Content Policy, our Acceptable Use Policy, or any applicable legal regulations.

No Liability for Moderation Actions: GenMago shall not be liable to you or any third party for any loss of access, loss of data, loss of artistic assets, or business interruption resulting from the removal, hiding, or deletion of flagged, reported, or non-compliant content.

Automated Multi-Layer Safety Systems: All generation requests are subjected to multi-stage real-time safety enforcement, including: (1) multi-lingual prompt text moderation, (2) automated safety filter parameter injection, and (3) automated Google Cloud Vision SafeSearch detection on generated output images.

In-App 'Report' Functionality: Every publicly visible artwork in the GenMago Community Gallery (/gallery) includes a direct 'Report' button (🚩). Any user or visitor may submit a report identifying violating content.

Immediate Automatic Hiding: When a report is submitted through the platform, the reported artwork is immediately hidden from public view (isPublic set to false across database and cache layers) and queued for manual human review by our safety moderation team.

Manual Review & Actions: Our moderation staff investigates all reported items. If a violation is confirmed, the item is permanently purged from Cloudflare R2 storage and database records, and the responsible account is suspended or blocked. If a report is determined to be a false positive, the content may be restored.

Direct Safety Contact: In addition to the in-app Report button, intellectual property holders and concerned users may report harmful content directly to [email protected] or [email protected] with the subject line 'Safety Violation Report' or 'DMCA Notice'. We respond to urgent safety notices promptly.

GenMago displays digital advertisements served by third-party advertising networks, including Google AdSense. Third-party advertising partners may use cookies and web beacons to serve advertisements based on your visits to this and other websites across the web.

The inclusion of any advertisement, hyperlink, or external banner does not imply endorsement by GenMago. We do not control and are not responsible for the content, privacy policies, or commercial practices of third-party advertisers or external websites.

Platform Assets: GenMago, including its original source code, web design, trademarks, user interface logos, and proprietary documentation, is owned by GenMago and protected by international copyright and intellectual property laws.

Digital Millennium Copyright Act (DMCA): We respect the intellectual property rights of artists and creators. If you believe in good faith that any content hosted on GenMago infringes upon your copyright, please send a written notification to our designated DMCA agent at [email protected] including: (a) identification of the copyrighted work claimed to have been infringed, (b) specific URL of the infringing material, (c) your contact information, and (d) a statement of good faith belief.

While core features of GenMago are free to access, optional Pro subscription tiers offer enhanced concurrency and priority generation queues.

All subscription payments are billed in advance on a recurring monthly or annual basis. You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of the current billing cycle.

GenMago and all included tools, algorithms, and content are provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the service will be uninterrupted, error-free, entirely secure, or that generated AI outputs will meet your specific artistic or technical requirements.

To the maximum extent permitted by applicable law, in no event shall GenMago, its founders, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill arising from your access to or use of the platform.

We reserve the right to revise or modify these Terms of Service at our sole discretion. Any changes will become effective upon being published to this page.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts having jurisdiction over the platform's registered operations.
